TERMS & CONDITIONS

BEING HUMAN CLOTHING – “SHOP FOR ₹10,000 & GET A CHANCE TO MEET & GREET SALMAN KHAN”

The following terms and conditions (“Terms and Conditions”) shall apply to the Being Human Clothing “Shop for ₹10,000 & Get a Chance to Meet & Greet Salman Khan” promotional activity (“Promotional Activity”) conducted by Four Aces Fashion House Private Limited a company incorporated under the Companies Act, 2013, CIN: U52609MH2019PTC335195 , having its registered office at 13th Floor, ABR Emerald, Plot No. D-8, Street No. 16, MIDC Marol, Andheri (East), Mumbai – 400 093 ("Organiser").

Salman Khan ("SK") is participating in the Meet & Greet event described herein solely in his personal capacity pursuant to a separate arrangement with the Organiser. SK has not organised, co-organised, endorsed or sponsored the Promotional Activity and shall bear no liability in connection with the administration, conduct or outcome of the Promotional Activity. The name, image and likeness of SK are referenced herein solely with his authorisation and for the limited purpose of describing the nature of the association with SK for the Meet & Greet event. All intellectual property rights in and to the name, image, voice, likeness and identity of SK vest exclusively with him.

1. ELIGIBILITY

1.1. The Promotional Activity is open to Indian citizens who are residents of India and are 18 years of age or above as on the date of participation.

1.2. Employees, officers, directors and representatives of the Organiser, its affiliates, agencies, service providers, promoters, shareholders, officers, participating partners, franchisees and staff of participating stores, and their immediate family members, as well as persons directly involved in organising or administering the Promotion, are not eligible to participate.

1.3. In view of the Tamil Nadu Prize Schemes (Prohibition) Act, 1979, the Promotional Activity is not open to residents of Tamil Nadu, and purchases made at stores in Tamil Nadu or delivered to addresses in Tamil Nadu shall not qualify.

1.4 The Organiser reserves the right to exclude residents of additional States or Union Territories if it determines, on the basis of applicable State law, that the format of this Promotional Activity is restricted or prohibited in such State or Union Territory. Any such exclusion shall be communicated through beinghumanclothing.com with reasonable prior notice.

1.5 The Organiser reserves the right to verify the eligibility of any customer at any stage of the Promotional Activity. The recording of a ticket does not constitute confirmation of eligibility.

2. PROMOTION PERIOD

2.1. The Promotional Activity shall be valid from 1 October 2026 to 30 November 2026, both dates inclusive (“Promotion Period”).

2.2 The Organiser reserves the right, subject to applicable law, to extend, shorten or otherwise modify the Promotion Period with reasonable notice through appropriate channels. Any such modification shall not affect the rights of customers who have already made qualifying purchases during the original Promotion Period, to the extent provided in these Terms and Conditions.

3. PARTICIPATION

3.1. Customers who purchase Being Human Clothing products in a single bill/invoice where the final amount paid, after all discounts and inclusive of GST, but excluding delivery charges and any other fees or surcharges, is ₹10,000 or moreduring the Promotion Period shall receive one (1) ticket for every complete ₹10,000 of the final amount paid (for example, a final amount paid of ₹20,000 earns two (2) tickets, ₹29,999 earns two (2) tickets). Online and store purchases qualify on exactly the same basis. The purchase of gift cards or vouchers does not qualify. Where a bill or online order is paid partly by gift card or voucher, only the amount paid by other means (i.e., excluding the gift card or voucher amount) counts towards the ₹10,000 threshold. Purchases made outside the Promotion Period shall not qualify for the Promotional Activity.


3.2. The Promotional Activity is valid at participating Being Human Clothing exclusive brand outlets in India, except those located in Tamil Nadu, and on beinghumanclothing.com.

3.3. Multiple bills/invoices cannot be clubbed or accumulated to meet the ₹10,000 qualifying purchase value.

3.4. Tickets are calculated separately for each bill/invoice. Each bill/invoice shall be recorded in the name of one customer, being the person who pays, and only that customer  may be selected on the tickets from that bill or online order, subject to verification of identity.

3.5. Returns remain available under the Organiser’s normal return policy and applicable law. However, the return of any item on a qualifying bill/invoice, in whole or in part, shall cancel all tickets earned on that bill/invoice, and they cannot be reinstated. Tickets from the customer’s other bills/invoices and their free entry shall not be affected. An exchange shall not affect the tickets, provided no amount is refunded; an exchange on which any amount is refunded shall be treated as a return.

3.6. Tickets are considered from the date of purchase, in store and online, and shall be cancelled if the bill/invoice is returned at any time before the selected customer has been verified. For store purchases, the customer’s full name as on their government photo identification and their mobile number shall be recorded at billing; a store bill not so recorded may be registered by the customer on the Promotional Activity page at beinghumanclothing.com, where it will be checked against the Organiser’s store records, before the end of the Promotion Period. For online purchases on beinghumanclothing.com, the name and mobile number recorded at the time of placing the order shall be the details against which the customer is verified. Whether the purchase was made in store or online, a customer who wishes to correct a clerical error in the name recorded against their bill or order (for example, a misspelling, incomplete name or missing initial) may do so by accessing the Promotional Activity page at beinghumanclothing.com and submitting a correction request before the close of the Promotion Period on 30 November 2026. The Organiser will review the request and, where satisfied that it constitutes a genuine correction and not a substitution of a different person's name, update the recorded name accordingly. No correction request submitted after 30 November 2026 shall be accepted. A name correction shall not be used to substitute a different person's name for that of the original customer.

3.7. A customer who signs up on beinghumanclothing.com for the first time between 1 October 2026 and 15 October 2026 (both dates inclusive) ("New Sign-Up") shall receive one (1) additional ticket on completing their first online purchase on beinghumanclothing.com after signing up, regardless of the value of that purchase. This additional ticket applies to online purchases only and to first-time sign-ups only; existing account holders are not eligible. If the first online purchase on which the additional ticket was earned is subsequently returned, the additional ticket shall be cancelled.

3.8. The Organiser shall not be responsible for incorrect, incomplete or inaccurate contact details provided by a customer.

3.9. The Organiser reserves the right to disqualify any ticket that does not comply with these Terms and Conditions or contains false, incorrect, incomplete or misleading information.


3.10. Each customer may hold a maximum of eleven (11) tickets: up to ten (10) tickets from qualifying ₹10,000 purchases and one (1) additional ticket from the first-purchase sign-up route in Clause 3.7 (where applicable). Every ticket has the same chance of selection. There is no ticket without a purchase.

3.11. Purchases made for resale, bulk or corporate orders, and purchases by distributors, franchisees or their staff, shall not qualify for the Promotional Activity.


4. SELECTION OF CUSTOMERS

4.1. Eligible customers shall be considered for selection for the opportunity to attend the Meet & Greet with Salman Khan (“Event”).

4.2. The selection shall be conducted through a random computerised draw from all valid tickets (“Draw”), at least fourteen (14) days before the Event (“Draw Date”) The Draw shall take place in January 2027 at a location in India to be determined by the Organiser. Before the Draw, the final list of valid tickets shall be locked and its digital fingerprint (hash) published on beinghumanclothing.com. An independent person (not the Organiser, not on camera) shall be present to witness the Draw and shall sign a short written confirmation that the Draw was conducted in accordance with these Terms and Conditions. Such confirmation shall be available for inspection by any customer upon written request to the Grievance Officer within 30 (thirty) days of publication of the Draw results.

4.3. Twenty-seven (27) customers shall be selected (“Winner”). Twenty-seven (27) reserve customers (“Reserve”) shall also be drawn, in ranked order, to replace any selected customer who is disqualified, cannot be contacted, fails verification or security clearance, or is unable to attend on the confirmed date. No customer may be selected more than once. In the event that a Winner or Reserve is disqualified due to a post-selection discovery that their qualifying bill/invoice has been returned or their entry was otherwise invalidated, the Organiser shall proceed to the next Reserve in ranked order. If all 27 Reserve customers have been exhausted without filling all 27 Winner slots, the Organiser reserves the right to conduct a supplementary draw from the remaining valid tickets to fill any unfilled slots. The customers acknowledge that the final decision in relation to the selected customers basis the outcome of the Promotional Activity will be that of the Organiser and it will be final and binding.

4.4. Participation in the Promotional Activity or receipt of a ticket does not guarantee selection for the Event.

4.5. The Organiser reserves the right, subject to applicable law, to disqualify a ticket where the customer is found to be ineligible or to have breached these Terms and Conditions.

4.6. The first name and city of each confirmed selected customer shall be published on beinghumanclothing.com and on the Organiser’s official Being Human Clothing social media handles within seven (7) days of the draw. Any customer may request confirmation of the result through the helpline in Clause 13.

5. SELECTED CUSTOMER NOTIFICATION AND VERIFICATION

5.1. Selected customers shall be notified by telephone and/or email using the contact details available in the Organiser's records. he Organiser shall not be responsible for non-delivery of notifications due to incorrect or outdated contact details provided by the customer, technical failures, network issues or any other circumstances beyond the Organiser's reasonable control. It is the customer's responsibility to ensure that the contact details recorded against their bill or online order are current and accurate.

5.2. The Organiser shall endeavour to notify selected customers of the Event details at least 14 (fourteen) days prior to the Event, and the Event date shall be treated as tentative until so confirmed, subject to finalisation of the Event schedule and circumstances beyond the Organiser's reasonable control.

5.3. A customer shall not be considered a confirmed selected customer until all required verification checks have been successfully completed.

5.4. Verification of selected customers shall be carried out in two stages:

Stage 1 — Upon notification of selection, the Organiser shall dispatch a one-time password ("OTP") to the mobile number recorded on the selected customer's qualifying bill or online order. The customer must confirm the OTP to the Organiser within 24 (twenty-four) hours of dispatch. Once the OTP is confirmed, the Organiser shall conduct a mandatory identity verification video call with the selected customer, which must be completed within 72 (seventy-two) hours of the first contact attempt. During the video call:

i) the customer must appear in person and confirm their identity verbally;

(ii) the customer must hold up, clearly visible to the camera, their original valid government-issued photo identification in the name recorded on the qualifying bill or online order (the document will be viewed by the Organiser's representative only and will not be recorded or copied; an Aadhaar card, if offered, must be masked in accordance with UIDAI guidelines, only the last four digits of the Aadhaar number need be visible); and

(iii) the customer must confirm their acceptance of these Terms and Conditions.

A selected customer who fails to confirm the OTP within 24 hours of dispatch, or who is unable or unwilling to participate in the mandatory video call within 72 hours of the first contact attempt, shall be disqualified and the next Reserve in ranked order shall be contacted. The Organiser shall make at least two (2) contact attempts by telephone and/or email before treating a customer as non-responsive.

Stage 2 — On the day of the Event, the selected customer must again produce, in person at the Event venue check-in point, the same original government-issued photo identification shown during Stage 1. A photocopy, digital copy or photograph of the identification document shall not be accepted at the venue. Stage 2 is required regardless of successful completion of Stage 1; both stages must be completed to the Organiser's satisfaction before the selected customer will be granted entry.

In addition to the above, selected customers shall provide:

a. the original/valid purchase invoice or order details (or, for free-entry customers, confirmation of registration details);

b. their PAN card details, for the purposes of tax compliance under Clause 6.9, if required; and

c. such other information or documents as may reasonably be required by the Organiser or the security team of SK for eligibility, security or Event administration purposes.

Failure or refusal to provide any of the above, or to complete either verification stage within the timelines specified by the Organiser, shall result in disqualification.

5.5. The Organiser reserves the right to reject or disqualify a selected customer who fails to satisfy the eligibility or verification requirements.

5.6. If a selected customer fails to confirm the OTP within 24 hours of dispatch, does not respond to the Organiser's notification within 72 (seventy-two) hours of the first contact attempt, or is unable to complete the required verification within the timelines set out in Clause 5.4, the Organiser shall disqualify that customer and proceed to the next Reserve in ranked order. The Organiser shall make at least two (2) contact attempts by telephone and/or email before treating a customer as non-responsive.

5.7. Only the selected customer personally may attend the Event. A selected customer shall be admitted only if all three of the following verification conditions are satisfied:

a) Bill/order validity: the qualifying bill or online order on which the winning ticket was earned has not been returned, cancelled, refunded or reversed (in whole or in part) at the time of verification;

(b) OTP confirmation: The OTP dispatched by the Organiser to the mobile number recorded on the qualifying bill or online order has been successfully confirmed by the customer within 24 hours of dispatch; and

(c) Original photo identification: The customer produces, in person at the Event venue check-in point, the same original valid government-issued photo identification shown during the Stage 1 video call, in the name recorded on the qualifying bill or online order (the document shall be viewed by the Organiser's representative only and shall not be copied or retained; an Aadhaar card, if offered, must be masked in accordance with UIDAI guidelines, only the last four digits of the Aadhaar number need be visible). A photocopy, digital copy or photograph of the identification document shall not be accepted at the venue.

Where the name on the identification document differs from the name recorded on the bill or online order by reason only of a minor spelling variation (for example, a transposition of letters, a missing initial or a common abbreviation of the same name), and the qualifying bill or online order and the mobile number through which the OTP was confirmed both match, the Organiser may, at its discretion, accept the identification as satisfactory.

A name that belongs to a different person shall not be accepted under any circumstances, regardless of any explanation offered. No other person may attend in the selected customer's place. Failure to satisfy all three conditions shall result in refusal of entry and disqualification, and the next Reserve in ranked order shall be contacted. The Organiser's determination as to whether the three conditions are satisfied shall be final.

Successful completion of Stage 1 verification under Clause 5.4 does not guarantee entry at Stage 2; both stages must be completed to the Organiser's satisfaction.


5.8. Attendance is subject to security clearance by the Event security team. A Winner who does not receive security clearance shall be replaced by the next Reserve customer.

5.9. Selected customers shall be required to execute, prior to attending the Event, such declarations, undertakings or other documents as may be reasonably required by the Organiser or SK's management team, including:

(a) a Declaration of Eligibility confirming compliance with these Terms and Conditions;

(b) a photography, recording and conduct undertaking confirming awareness of and agreement to the restrictions in Clauses 7.3, 7.4 and 7.5;

(c) a Photograph Use Consent Form, being a separate, freely given, informed and specific consent under the Digital Personal Data Protection Act, 2023, by which the Winner may (but is not required to) consent to the Organiser using photographs taken of the Winner at the Event for promotional purposes, including on beinghumanclothing.com and the Organiser's official social media handles, in accordance with Clause 9.2; and

(d) such other documents as may be required for security clearance or Event administration purposes.

Failure or refusal to execute any such documents above shall result in disqualification, and the next reserve customer shall be contacted.

6. MEET & GREET

6.1. The selected customers shall have an opportunity to attend a Meet & Greet with Salman Khan in Mumbai, Maharashtra, on the day of the Being Human Clothing SS27 shoot with SK, currently expected in January 2027 (tentative), subject to the final Event arrangements. The Meet & Greet shall be limited to the selected Winners only. No guests, companions or additional attendees shall be permitted to accompany the Winners at the Event unless expressly approved in advance and in writing by the Organiser and SK's management team.

6.2. The Event date, time, venue and format shall be determined by the Organiser and communicated to selected customers. Selected customers will not have access to the shoot set or to any unreleased products. The format, duration and nature of the Meet & Greet (including the duration of interaction with SK, photography arrangements, and any seating or standing arrangements) shall be at the sole discretion of the Organiser and SK's management team. No specific format, minimum duration or nature of interaction is guaranteed.

6.3. All travel, accommodation, food, local transportation and other personal expenses incurred by the Winner in connection with attending the Event shall be borne by the Winner. The Organiser shall not provide or reimburse any travel or accommodation costs. As the Event date is tentative until confirmed by the Organiser (see Clause 6.5), Winners are strongly advised to book refundable or flexible travel and accommodation only. The Organiser shall not be liable for any cancellation, rebooking or change charges incurred by a Winner as a result of any rescheduling of the Event..

6.4. The Meet & Greet opportunity is strictly personal to the selected Winner and non-transferable.  It cannot be sold, gifted, transferred, assigned, exchanged, redeemed or substituted for cash, credit, voucher or any other monetary or non-monetary benefit whatsoever. Any attempt by a Winner to sell, transfer or assign the Meet & Greet opportunity shall render it null and void and shall result in immediate disqualification.

6.5. The Event, including SK's participation therein, is subject to his availability, health, safety, prior professional commitments and willingness to participate at the time of the Event. The Event may be postponed, rescheduled, modified or cancelled at any time, including due to force majeure, security threats or concerns, health reasons, court orders, regulatory action or unforeseen professional obligations of SK. In the event of any such postponement, rescheduling, modification or cancellation, the Organiser shall make reasonable efforts to communicate the change to the selected Winners. The provisions of Clause 6.7 shall apply in the event of postponement. No liability whatsoever shall attach to SK, his management, agents or representatives in connection with any postponement, rescheduling, modification or cancellation of the Event.

6.6. The Organiser does not guarantee the duration, format or nature of the interaction with SK.

6.7. If the Event cannot take place on the scheduled shoot day, it shall be moved to the next shoot day with SK, and shall be held on or before 31 December 2027, save where prevented by force majeure. No other compensation shall be payable.

6.8. Winners may not be accompanied by any other person.

6.9. As the prize has no cash value and no travel or accommodation is provided by the Organiser, the Organiser expects that no tax will be deductible or payable in respect of the Meet & Greet opportunity under applicable law, including under Section 194B of the Income Tax Act, 1961. Any tax that is determined by the Organiser's finance team or by applicable law to be payable in respect of the Meet & Greet opportunity shall be borne by the Winner.

7. EVENT RULES AND CONDUCT

7.1. Attendance at the Event shall be subject to applicable venue, security and safety requirements and instructions issued by the Organiser, venue and security personnel. Winners must at all times comply with the instructions of the Organiser, venue management, security personnel and SK's personal security team. Failure to comply with any such instruction may result in immediate removal from the Event and forfeiture of the Meet & Greet opportunity without compensation.

7.2. The Organiser reserves the right to refuse entry or remove any person from the Event where reasonably necessary for safety, security, legal compliance or orderly conduct. The decision to refuse entry or remove a person from the Event shall be final and binding on the customer. No compensation, refund or alternative benefit shall be provided in such circumstances.

7.3. Selected customers shall comply with all restrictions imposed by the Organiser or SK's management team relating to photography, videography, recording, audio recordings, social media posting, personal belongings, interaction, autograph requests and any other conduct during the Event.

7.4. Mobile phones and camera usage may be restricted by the Organiser for part or all of the Event. The decision to hold or restrict mobile phones, cameras or other recording devices shall be at the absolute discretion of the Organiser and SK's security team and shall not be subject to challenge. A Winner who refuses to comply with any device restriction shall be refused entry to, or removed from, the Event without compensation. The Organiser will photograph each selected customer with SK and share the photograph with them after the Event. No guarantee is given as to the timing, format or quality of the photograph. All intellectual property rights in Event Content (including photographs) featuring SK vest exclusively in the Organiser and/or SK's authorised representatives.

7.5. Photographs, videos or recordings of SK taken at or received from the Event may be kept and shared for personal, non-commercial use only. They may not be used for any commercial purpose, or in any way that suggests SK endorses any person, product, business or cause. For the avoidance of doubt, "personal, non-commercial use" shall not include: (a) posting on social media accounts operated for or in connection with a business or commercial activity; (b) use in any advertisement, promotional material or sponsored content; (c) sale or licensing to any third party; or (d) use in any manner that generates revenue, directly or indirectly, for the Winner or any third party. Further, the Winners acknowledge that they shall not modify/edit the photograph including SK, in any manner whatsoever. Winners acknowledge that any breach of Clause 7.5 or 7.5A constitutes an infringement of SK's personality rights and right of publicity under Indian law, and that the Organiser and/or SK shall be entitled to seek injunctive relief and damages in respect of any such breach, without prejudice to any other remedy available. Winners who post Event photographs on personal social media platforms for genuine non-commercial purposes shall ensure that such posts do not imply any endorsement by SK of any product, brand, service, political party or cause. The use of hashtags or tags that imply commercial association is prohibited.

7.6 Winners must at all times during the Event conduct themselves in a lawful, respectful and dignified manner. Without limitation, Winners shall not:

a) approach, follow or attempt to make unsolicited physical contact with SK beyond what is facilitated by the Organiser;

(b) make any verbal statement or gesture that is threatening, abusive, harassing or sexually inappropriate;

(c) attempt to access areas of the venue beyond those designated for the Event;

(d) attempt to obtain SK's personal contact details;

(e) bring any item to the Event venue that is designated as prohibited by the security team; or

(f) engage in any conduct that, in the reasonable opinion of the Organiser or SK's security team, is disruptive, unsafe or otherwise inappropriate.

The Organiser and SK's security team shall have absolute discretion to determine whether conduct violates this Clause 7.6 and to remove any Winner accordingly. A removed Winner shall forfeit the Meet & Greet opportunity without compensation.

8. PERSONAL DATA

8.1. By participating in the Promotional Activity, customers acknowledge that the Organiser, acting as a "Data Fiduciary" under the Digital Personal Data Protection Act, 2023 ("DPDPA"), shall collect and process personal data including: name, age, mobile number, email address, city, government-issued identification details (viewed only, not copied), purchase details, marketing consent status, and such other information as may be collected in the course of administering the Promotional Activity and the Event ("Personal Data"). [If tax applies: PAN card details (for selected customers only, for tax compliance under Clause 6.9).] Customers shall constitute "Data Principals" for the purposes of the DPDPA.

8.2. Personal information may be used for purposes including:

a. administering the Promotion;

b. verifying eligibility and identity;

c. contacting selected customers;

d. arranging and administering the Event;

e. preventing fraud or misuse; and

f. complying with applicable legal requirements.

g. sending marketing communications to customers who have separately and expressly opted in to receive them, in accordance with Clause 8.6 below.

8.3. Personal information shall be processed in accordance with Digital Personal Data Protection Act, 2023, the Information Technology Act, 2000  and the Organiser's applicable Privacy Policy available at beinghumanclothing.com/privacy-policy.

8.4. Personal Data of customers who are not selected shall be deleted within ninety (90) days after the Draw. Personal Data of Winners and Reserves shall be deleted within ninety (90) days after the Event. In each case, deletion shall be carried out save where a longer retention period is required by applicable law (for example, tax records may be required to be retained for the period prescribed under applicable tax law). Notwithstanding the foregoing, Personal Data of any customer who has given a separate and express marketing consent under Clause 8.6 shall be retained under the Organiser's Privacy Policy at beinghumanclothing.com/privacy-policy for as long as the consent subsists and shall not be subject to the deletion schedule above until that consent is withdrawn. Customers may withdraw consent to marketing communications, or seek correction or erasure of their Personal Data, by contacting the Grievance Officer through the helpline in Clause 13.

8.5 Marketing Consent and Opt-in:

The Organiser collects customer data as part of this Promotional Activity and invites customers to optionally receive marketing communications from Being Human Clothing.

At the point of sign-up on beinghumanclothing.com, and through the link in the ticket SMS sent to store customers, customers will be presented with the a consent notice and opt-in. Taking part in the Promotional Activity shall never be conditional on giving marketing consent. The opt-in box shall be unticked by default. Consent given under this Clause is freely given, specific, informed and unambiguous within the meaning of the Digital Personal Data Protection Act, 2023. Data of customers who opt in shall be retained under the Organiser's Privacy Policy until consent is withdrawn, as set out in Clause 8.4.

9. PHOTOGRAPHY, VIDEO AND PUBLICITY

9.1. The Event may be photographed, filmed, recorded and/or otherwise documented by or on behalf of the Organiser or its authorised representatives. All intellectual property rights in any photographs, films, recordings or other content created at the Event by or on behalf of the Organiser ("Event Content") shall vest in and remain with the Organiser and/or SK's authorised representatives, as applicable. No Winner shall acquire any ownership or licence rights in Event Content featuring SK by virtue of receiving a photograph under Clause 7.4.

9.2. The Organiser's photographer will take a photograph of each Winner with SK at the Event and share it with the Winner. Subject to the Winner having given a separate, freely given and informed consent under Clause 5.9(c) and the Digital Personal Data Protection Act, 2023, the Organiser may use the Winner's photograph (featuring the Winner and SK) for promotional purposes, including on beinghumanclothing.com and the Organiser's official social media handles.

9.3. Any use of personal information or images for purposes beyond administering the Promotional Activity shall be subject to applicable law and the relevant privacy/consent requirements.


10. CANCELLATION, MODIFICATION AND DISQUALIFICATION

10.1. The Organiser reserves the right, subject to applicable law, to modify, suspend, postpone, withdraw or cancel the Promotional Activity or Event where reasonably necessary, including due to technical issues, security concerns, venue restrictions, force majeure, governmental restrictions or circumstances beyond the Organiser's reasonable control. In the event of cancellation of the Promotional Activity prior to the selection of Winners, the Organiser shall communicate the cancellation through beinghumanclothing.com and its official social media handles. Customers shall have no claim against the Organiser or SK for cancellation of the Promotional Activity prior to selection.

10.2. The Organiser may amend these Terms and Conditions where reasonably necessary, subject to applicable law.

10.3. Any material change to the Promotional Activity or these Terms and Conditions shall be communicated through beinghumanclothing.com and/or the Organiser's official social media handles, with reasonable prior notice where practicable.

10.4. If the Promotional Activity is withdrawn or cancelled before the end of the Promotion Period, tickets validly made up to the date of withdrawal shall remain valid and shall be included in the Draw.

10.5. The Organiser reserves the right to disqualify, at its sole discretion, any entry or selected customer where:

(a) the entry involves false, incomplete, misleading, fraudulent or invalid information;

(b) these Terms and Conditions have been breached;

(c) the customer engages in any conduct that is disruptive, threatening, abusive, harassing, illegal or otherwise inappropriate in connection with the Promotional Activity or the Event, whether in person or on social media;

(d) the customer attempts to circumvent the Promotional Activity mechanics or the selection process; or

(e) any other reasonable ground for disqualification exists.

Disqualified entries shall be void and disqualified customers shall have no claim against the Organiser or SK.

11. INDEMNITY AND LIMITATION OF LIABILITY

11.1. By participating in the Promotional Activity and/or attending the Event, each customer agrees to indemnify and hold harmless the Organiser, Being Human Clothing, and SK, his management, agents, representatives and security personnel (collectively, "Indemnified Parties") from and against any claims, losses, liabilities, costs and expenses (including reasonable legal fees) arising directly out of:

(a) the customer's wilful misconduct in connection with the Promotional Activity or the Event;

(b) any fraudulent representation made by the customer in connection with the Promotional Activity; or

(c) the customer's misuse of SK's image, name, likeness or any Event Content, including photographs taken at or shared from the Event, in breach of Clause 7.5.This indemnity is to the maximum extent permitted under applicable law and is without prejudice to any other rights or remedies available to the Indemnified Parties.

11.2. To the maximum extent permitted by applicable law, neither the Organiser nor SK, his management, agents or representatives, shall be liable to any customer for any direct, indirect, incidental, consequential, special or exemplary loss, damage or expense arising out of or in connection with: (a) participation or non-participation in the Promotional Activity; (b) any postponement, rescheduling, modification or cancellation of the Event; (c) any act, omission or decision of SK in connection with the Event or his participation therein; (d) any failure of telecommunications, internet or technical systems; (e) any lost, late, incomplete or misdirected tickets or OTP confirmations; or (f) any other matter beyond the Organiser's reasonable control. The Organiser shall not be responsible for any travel, accommodation, food, local transportation or other personal expenses incurred by any Winner in connection with the Event. SK is not a party to these Terms and Conditions and assumes no obligation, liability or responsibility in connection with the Promotional Activity. Any claim by a customer must be directed solely to the Organiser.


11.3. Nothing in these Terms and Conditions shall exclude or limit any liability or consumer right that cannot lawfully be excluded or limited under applicable Indian law.

12. GENERAL

12.1. By participating in the Promotion, the customer is deemed to have read, understood and accepted these Terms and Conditions. Customers are encouraged to read the full Terms and Conditions available at beinghumanclothing.com before participating.

12.2. The decision of the Organiser regarding eligibility and administration of the Promotional Event shall be made in accordance with these Terms and Conditions and applicable law. The decision of the Organiser in respect of any dispute relating to eligibility, the selection process or any other matter relating to the Promotional Event shall be final, binding and not subject to further challenge, except to the extent provided under applicable consumer protection law.

12.3. If there is any inconsistency between these Terms and Conditions and any promotional material relating to the Promotion, these Terms and Conditions shall prevail to the extent of such inconsistency.

12.4. The Promotional Activity is subject to applicable laws of India.

12.5. This Promotional Activity is a purchase-linked promotional scheme conducted by the Organiser. All tickets are earned through genuine commercial transactions for Being Human Clothing products, either through qualifying purchases of ₹10,000 or more (Clause 3.1) or through a first-time online sign-up and first purchase of any value (Clause 3.7). In each case, the consideration paid by the customer is for goods; the ticket is a collateral promotional benefit incidental to the purchase transaction. There is no ticket without a purchase. The Organiser does not characterise this Promotional Activity as a lottery within the meaning of the Lotteries (Regulation) Act, 1998.

12.6. The Promotional Activity shall be conducted in compliance with the Code for Self-Regulation of Advertising Content in India issued by the Advertising Standards Council of India (ASCI). The Organiser shall honour the prize as described in these Terms and Conditions, subject to Clauses 6.5 and 6.7.

13. GRIEVANCE REDRESSAL

13.2. The Organiser shall acknowledge any grievance within 48 (forty-eight) hours of receipt and shall endeavour to resolve it within 30 (thirty) days of receipt, in accordance with the Consumer Protection Act, 2019 and the Consumer Protection (E-Commerce) Rules, 2020.

14. GOVERNING LAW AND JURISDICTION

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of India.

The courts having competent jurisdiction in Mumbai, Maharashtra shall have exclusive jurisdiction over matters arising from these Terms and Conditions.
